A new question has been introduced during the application process to identify members transitioning to Medicare. This ensures timely termination of Marketplace coverage as required by the Federally Facilitated Marketplace (FFM).
All EDE partners that are currently displaying messages referencing Marketplace eligibility for DACA recipients and other noncitizens must update their website to include the new language provided by CMS.
Due to a court order issued on December 9, 2024, Deferred Action for Childhood Arrivals (DACA) recipients and consumers with certain other immigration statuses listed below are no longer eligible for Marketplace coverage if they live in these states: Alabama, Arkansas, Florida, Idaho, Indiana, Iowa, Kansas, Kentucky, Missouri, Montana, Nebraska, New Hampshire, North Dakota, Ohio, South Carolina, South Dakota, Tennessee, Texas, and Virginia.
Non-citizen applicants without SSNs, other than newborns born in the past 90 days, are required to provide verifiable information from their immigration documentation. Agent/broker can continue when they don't provide a verifiable SSN for a noncitizen applicant, but will be blocked from continuing if they do not provide verifiable immigration document information.
Agent/Broker can request the consumer to submit the enrollment by sending a link to JET Application when they receive 'Invalid Action' error from CMS. This enables consumers to review the application details and submit the enrollment themselves.
Agents are now required to upload consumer consent or attest that they are maintaining consumer consent when they submit a new enrollment or update an existing application.
